Tri-Stars All-Activities Participation Waiver

TRI-STARS SPORTS & EVENTS PARTICIPATION AGREEMENT, ASSUMPTION OF RISK, RELEASE, MEDICAL AUTHORIZATION, AND INDEMNIFICATION AGREEMENT 1. Covered Activities and Persons This agreement applies to the undersigned parent/legal guardian and every minor participant linked to the family account (“Participant”). Covered activities include recreational and competitive gymnastics, tumbling, cheer, fitness and conditioning; batting-cage use, baseball/softball training, private lessons, team practices and rentals; birthday parties, open gym, camps, clinics, special events, facility rentals, spectator presence, and all related activities on or off premises conducted, sponsored, arranged, or supervised by Tri-Stars Sports & Events and its programs (“Tri-Stars”). 2. Acknowledgment of Risks I understand these activities involve inherent and other risks, including falls; collisions with people, equipment, walls, floors, nets, balls, bats, apparatus, inflatables, furniture, or structures; improper landings; overexertion; equipment failure or misuse; actions of participants, guests, spectators, coaches, instructors, vendors, or other third parties; illness exposure; and risks arising during arrival, departure, observation, free play, food service, and facility use. Injuries may include sprains, fractures, dental or eye injury, concussion, paralysis, serious permanent disability, or death. I acknowledge that protective equipment, rules, instruction, supervision, and spotting cannot eliminate every risk. 3. Participant Fitness and Rules I represent that each Participant is physically and medically able to participate except for conditions disclosed in writing. I will provide accurate medical, allergy, medication, behavioral, and emergency information and update it when necessary. Participants and guests must follow staff instructions, posted rules, age/skill restrictions, equipment requirements, and facility policies. Tri-Stars may restrict or end participation when it reasonably believes safety is at risk. 4. Voluntary Participation and Assumption of Risk I voluntarily choose participation for myself and/or authorize each minor Participant to participate. To the fullest extent permitted by Illinois law, I knowingly assume the inherent and ordinary risks of the Covered Activities, whether known or unknown and whether described above or not. 5. Release and Covenant Not to Sue TO THE FULLEST EXTENT PERMITTED BY LAW, I RELEASE AND AGREE NOT TO SUE TRI-STARS SPORTS & EVENTS, ITS OWNERS, AFFILIATES, PROGRAMS, LANDLORDS, PROPERTY OWNERS, EMPLOYEES, COACHES, INSTRUCTORS, VOLUNTEERS, CONTRACTORS, VENDORS, EVENT HOSTS, AND AGENTS (“RELEASED PARTIES”) FOR CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF A RELEASED PARTY OR FROM THE INHERENT RISKS OF THE COVERED ACTIVITIES. THIS PROVISION DOES NOT PURPORT TO RELEASE WILLFUL AND WANTON MISCONDUCT, GROSS NEGLIGENCE WHERE IT CANNOT LAWFULLY BE RELEASED, INTENTIONAL MISCONDUCT, OR ANY LIABILITY THAT ILLINOIS LAW DOES NOT PERMIT TO BE WAIVED. I understand the enforceability and scope of a parent’s release of a minor’s claims may be limited by applicable law. 6. Batting-Cage-Specific Acknowledgments I understand pitched or struck balls and moving machinery may cause serious injury. Participants will remain outside cages until authorized, use only designated entrances and equipment, wear required helmets, keep gates closed, never enter the pitching-machine area, and follow all speed, age, occupancy, footwear, and supervision rules. 7. Gymnastics and Event-Specific Acknowledgments I understand elevated apparatus, tumbling surfaces, trampolines, pits, inflatables, party equipment, games, crowds, food, decorations, and free-play areas create additional risks. Only authorized participants may enter activity areas, use equipment, or attempt skills. Parents/guardians remain responsible for supervising nonparticipating children and guests except where Tri-Stars expressly assumes supervision. 8. Emergency Care and Medical Authorization If I cannot be reached, I authorize Tri-Stars to obtain first aid, emergency medical evaluation, ambulance transportation, hospital care, anesthesia, surgery, and other treatment reasonably believed necessary for a Participant. I understand Tri-Stars does not provide health insurance and I accept financial responsibility for medical costs. This authorization does not require Tri-Stars to provide treatment and does not replace emergency contact information. 9. Indemnification To the fullest extent permitted by law, I agree to indemnify and hold the Released Parties harmless from claims, liabilities, damages, and reasonable costs arising from my conduct, a Participant’s conduct, my guests, violation of rules, or inaccurate/incomplete information, except to the extent caused by conduct that cannot lawfully be released or indemnified. 10. Personal Property and Facility Damage Tri-Stars is not responsible for lost, stolen, or damaged personal property except as required by law. I accept responsibility for damage caused by myself, Participants, or guests beyond ordinary wear. 11. Photo and Media Any photo/media consent is optional and is recorded separately. Refusing media consent does not prevent participation. 12. Electronic Transactions and Records I consent to electronic records and signatures. I understand that typing my legal name and selecting the acknowledgment boxes constitutes my electronic signature. I may download or print the document before signing and will receive or be given access to a completed copy. Tri-Stars may retain the signed electronic record for legal, insurance, and administrative purposes. 13. Severability, Illinois Law, and Entire Agreement Illinois law governs this agreement. If any provision is invalid or unenforceable, the remaining provisions remain effective to the fullest extent permitted. This agreement, together with the identified current policies, constitutes the agreement concerning the subjects addressed and may be modified only in a later written/electronic version presented for acknowledgment. 14. Parent/Guardian Certifications I certify that I am at least 18 years old and am the Participant’s parent or legal guardian with authority to sign. I have read the entire agreement, understand it contains an assumption of risk and release of liability, had the opportunity to ask questions and consult counsel, and sign voluntarily.
